HAMBURG, N.Y. — Police say a dispatcher with the Erie County Sheriff's Office was behind the wheel in a DWI accident in which two people were critically injured.

According to the Hamburg Police Department, officers were on Route 5 around 11 p.m. Monday when Thomas Gilray Jr., 28, drove his pickup around a police car, nearly hitting an officer, and then hit a disabled vehicle. That vehicle went forward, crashing into two passengers who were standing in front of it.

An unidentified 61-year-old Hamburg resident and 32-year-old Duchess County resident were taken to ECMC and remain in critical condition.

Gilray was charged with driving while intoxicated, vehicular assault, and other charges.

The Sheriff's Office confirms Gilray has been a dispatcher there for nearly three years.

Gilray was arraigned in Hamburg Town Court and was remanded on $5,000 bail. He is on unpaid leave until further notice.
