Three people who admitted to robbing a bank in Cheektowaga will spend the next three years behind bars. Darian Allen, Porche Allen, and Anotinette Freeman were sentenced in Erie County Court Thursday morning. YNN's Kevin Jolly tells they could have received a much longer sentence.
BUFFALO, N.Y. — "It was a 40 second bank robbery that was calculated and premeditated," said Erie County prosecutor Sara Ogden.
That's how prosecutor Ogden described the terrifying scene that took place in the Bank of America on Dick Road in Cheektowaga last June, when Darian Allen, along with his sister Porche Allen and cousin Antoinette Freeman, entered the bank.
"Antoinette Freman went in there with what everyone else in that bank thought was a real gun and she waved it around she threatened to kill people. She told managers, employees, and customers to get behind the counter to get on the floor," said Ogden.
The three were arrested a short time later after police traced the vehicle they were driving to a house in Buffalo.
In September, the three pleaded guilty to second degree robbery. They claim it was motivated by financial desperation.
Thursday, the trio was sentenced to the minimum 3½ behind bars. Prior to their sentencing, each one apologized for the crime.
"I take full repsonsibility for everything I did do," said Porche Allen.
"That's not even me from the jump. I don't know why it even went down, but I take full responsibilty for what I am," said Darian Allen.
"I want to apologize not only to my family and friends but to the individuals who were in the bank," said Antoinette Freeman.
Judge Kenneth Case says under normal circumstances, the three could have recieved as much as ten years behind bars, but he took into consideration their lack of a criminal history and their cooperation with police in handing down his sentence.
"I realize that this gun was an unloaded BB gun but the people in the bank didn't know that and this could have ended much more catastrophically than it did," said Case.
In addition to being sentenced to three and a half years in prison, they'll be under five years supervised probation upon release.
